ESTATE PLANNING

Probate

Passing without a will or trust will require a potentially lengthy and expensive, not to mention public, court process called probate. With a proper estate plan in place, your family could avoid most of the time and expense of the probate process. It can also serve to keep private the affairs of your estate.

WHAT IS PROBATE

Understanding the Probate Process

When a loved one passes away, their estate may need to go through probate – a court-supervised process for settling their affairs. At Grayson Law, we help clients in Chandler and throughout metro Phoenix , Arizona, navigate probate efficiently…and with as little stress as possible.

What is Probate?

Probate is the legal process of validating a will (if one exists), settling debts, and distributing assets to heirs or beneficiaries. If the deceased had a valid will, the probate court ensures that their wishes are carried out. If there is no will, Arizona law determines how assets are distributed.

What Happens During Probate?
The probate process typically includes:

  • Filing a Petition – A formal request is made to the court to open probate and appoint an executor or personal representative.
  • Notifying Creditors & Heirs – The executor notifies beneficiaries and publishes notice to potential creditors.
  • Inventory & Appraisal – The estate’s assets are identified, valued, and documented.
  • Settling Debts & Taxes – Outstanding debts and any necessary taxes are paid from the estate.
  • Distributing Assets – Once all obligations are met, remaining assets are distributed according to the will or state law.
  • Closing the Estate – A final accounting is submitted to the court, and probate is officially closed.
How Long Does Probate Take?
The length of probate depends on the complexity of the estate. In Arizona, a straightforward probate case may take several months, while more complicated estates can take a year or longer.
Can Probate Be Avoided?
Yes! Many people choose to create a trust or use other estate planning tools to avoid probate, ensuring a faster and more private transfer of assets.
